It is common that Canadian employers wish to retain foreign workers permanently. The procedure to follow depends on the kind of work permit the worker has or if the foreign worker is not in Canada. For example, a person with a Working Holiday Visa will have to apply under different rules than a person who holds a Post Graduate Work Permit in Canada.
In the latter case (Post Graduate Work Permit), the process has some exceptions. For example, the employers who wish to retain skilled foreign workers who hold a valid Post Graduate Work Permit in Canada will still need to apply for a Labour Market Opinion but the employer will not need to advertise the position, which means, the process will be faster, safer and cheaper. There are a couple of conditions for this; one is to be employed in a high-skilled position, and the other one is to have a valid wage according to the Canadian standards set up for that specific position.
Whether the workers are in Canada or overseas, Canadian employers like to sponsor skilled foreign workers, but it is important to consider that they must meet several requirements prior to being authorized to hire foreign workers in Canada on a long-term basis.
Some of the general requirements include to have a good history with the government, having declared and paid taxes and not having any labour disputes with foreign workers; the Canadian companies must also show general documentation of the business such as payroll statements, tax summaries, business licences, the number of local employees may be relevant as well, etc.
